Leglislation Overview

From 14th December 2007 a Home Information Pack will be required on all residential properties marketed for sale with the exception of new build properties.

Until June 2008 there remains no barrier to First Day Marketing. Providing the agent has proof that they have ordered the HIP they can proceed with marketing without having to wait for any documents. From June 2008 this will change and the house must not be marketed until the Evidence of Title, The Sales Statement and the EPC have been completed.

Currently, the EPC graphs must be incorporated into written particulars when the agent receives the completed EPC. There is no prescription as to how large they must be or where they must appear on the particulars. There is currently no "drop dead" date when all properties irrespective of when they were marketed will need a HIP.
